SECONDARY MARKET POLICY
1. INTRODUCTION
Venta de Boletos por Computadora, S.A. de C.V. (“Ticketmaster”) is a company legally incorporated under the laws of the United Mexican States with registered office at Calle Independencia No. 90, Colonia Centro, Alcaldía Cuauhtémoc, C.P. 06050, Mexico City, Mexico, with federal taxpayer registration number VBC910617SR1.
This Secondary Market Policy (the “Policy”) sets forth the terms and conditions applicable to the purchase and sale of tickets on the secondary market through the Ticketmaster platform.
We share with you the following definitions that will apply to our Policy:
- “Ticket(s)” means tickets to access events marketed through Ticketmaster.
- “Secondary Market Ticket(s)” means those tickets that have been purchased through the Ticketmaster platform and are offered for sale through the Secondary Market service (hereinafter, the “Secondary Market”). Secondary Market Tickets may not be offered at a price higher than the price at which they were originally purchased.
- “Seller” shall be the person who purchases the Ticket(s) directly from Ticketmaster and, in turn, offers them for sale through the Secondary Market.
- “Buyer” shall be the person who purchases the Ticket(s) through Ticketmaster's Secondary Market platform.
We reserve the right to make changes to this Secondary Market Policy at any time. It is understood that when we make such changes, we will publish the updated version of this Secondary Market Policy on our official website (https://www.ticketmaster.com.mx/). Therefore, we recommend that you consult this Secondary Market Policy regularly to stay informed about its current terms and conditions. All sales and purchases are subject to the applicable version of this Secondary Market Policy published at the time of the Ticket offer, sale, or purchase. If you do not agree with any revised version of this Secondary Market Policy, or if you are unable to comply with it, you must refrain from offering, selling, and purchasing Secondary Market Tickets.
2. GENERAL TERMS AND CONDITIONS
Ticketmaster operates an online platform where you can purchase tickets, secondary market tickets, and event-related merchandise. You must have a Ticketmaster account to use the platform.
Please see our Privacy Notice and Cookie Policy for more information on how we use and protect your personal data. You must not use our website or app, including the Secondary Market (collectively, the “TM Services”) for any purpose that is not legal or that does not comply with our Policies. If any anomaly or misuse of your account is detected, Ticketmaster reserves the right to terminate your account.
Ticketmaster provides a secure marketplace for tickets, allowing fans who have purchased tickets and are unable to attend their event for any reason to offer them to third parties, who can be confident that their Secondary Market Tickets are verified.
If we need to contact you, we will use the contact details in your Ticketmaster account. It is your responsibility to update any changes to your contact information at any time, whether before or after receiving any Secondary Market Tickets. Be sure to provide a valid email address, as this is our primary method of contact. You should also be aware that your email settings may treat our emails as junk mail, so remember to check your junk and/or spam folders.
If you wish to delete your personal data or close your Ticketmaster account, you can send your request using the form available in our Privacy Notice using the email address associated with your account. You can also contact us directly by writing to: privacy@ticketmaster.com.mx.
The titles used in this Policy are for reference purposes only and do not affect its interpretation. Capitalized terms in this Secondary Market Policy shall have the special meaning attributed to them as set forth herein.

3. PURCHASE AND SALE OF TICKETS ON SECONDARY MARKET
When you sell or purchase a Secondary Market Ticket, the relationship is directly with the buyer or seller (as applicable) for the corresponding Secondary Market Tickets, as these are the exclusive property of the seller and not Ticketmaster, and the buyer is purchasing them directly from the seller through the Secondary Market. Remember that Ticketmaster platform only facilitates the purchase and sale of Secondary Market Tickets between buyers and sellers, so Ticketmaster only acts as an intermediary in the purchase of Secondary Market Tickets.
To sell or purchase a Secondary Market Ticket, you must: (i) be of legal age, (ii) have the legal capacity to make the sale or purchase, (iii) have a Ticketmaster account, and (iv) have a valid credit or debit card issued in your name that can receive funds in local currency.
If you are offering and/or selling a Secondary Market Ticket, you will also need to have a Hyperwallet account, which we will set up for you, for which you must accept Hyperwallet's Policies, Terms, and Conditions. Hyperwallet is a service offered by PayPal through which the seller will receive the payment for the Secondary Market Tickets offered on the Ticketmaster platform.
All prices for Secondary Market Tickets offered for sale include Value Added Tax (VAT) and are broken down as follows:
- Secondary Market Ticket sale price (“Sale Price”); plus,
- Applicable service charges per Ticket (“Service Charge”).
In some cases, sellers may reduce (within certain limits) the Sale Price of Secondary Market Tickets at any time before the order is processed.
Please note that all seat maps and graphics displayed during the purchase process are illustrative and reflect the general layout of the venue for the particular event. For some events, the layout and specific seat locations may vary without notice.
All Secondary Market Ticket purchases are final and cannot be canceled, refunded, or exchanged, except as provided in this Policy.
By posting, selling, or purchasing a Secondary Market Ticket on the Ticketmaster platform, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Policy, as well as other applicable Ticketmaster Policies, which constitute a binding legal agreement between the parties for the use of the Secondary Market.
3.1. Purchasing Tickets on the Secondary Market
When you purchase Secondary Market Tickets and make the corresponding payment, your order will be processed and you will receive an “Order Confirmation” notification. After receiving the confirmation, you must follow the exact instructions we provide to complete the delivery of the Secondary Market Tickets.
Accepted payment methods are Visa, MasterCard, and American Express debit or credit cards. Gift cards cannot be used to pay for Secondary Market Tickets.
If you did not receive an Order Confirmation after submitting your payment information, or if you receive an error message or service interruption after submitting your payment information, please use our Help Center.
All purchases are subject to verification of the personal information and credit or debit card details provided by the purchaser. If the credit or debit card issuing bank does not authorize the payment, the purchase may be canceled.
Secondary Market Tickets will be delivered directly by email to your Ticketmaster account, and you will be responsible for ensuring that you log in to your account and download the Secondary Market Tickets.
We remind you that it is your responsibility to immediately check the information on your Secondary Market Tickets once they have been delivered to verify that there are no errors. If you detect errors with your Secondary Market Tickets or if you do not receive your Secondary Market Tickets as requested and/or as described in the Order Confirmation, please contact Ticketmaster through our Help Center.
3.2. Sale of Tickets on the Secondary Market
As a seller of Secondary Market Tickets, you may only offer your Tickets for sale on the secondary market through the Ticketmaster platform if they were purchased on the Ticketmaster Mexico website or app, provided that this feature is enabled and available in your Ticketmaster account.
In particular, the following Tickets may not be offered for sale on the Secondary Market:
- Tickets collected at box offices.
- Tickets purchased at Ticketmaster points of sale other than www.ticketmaster.com.mx.
- Tickets that were first purchased through agents, establishments, promoters, or other third parties.
- Tickets obtained as complimentary tickets and/or obtained through promotional benefits and/or purchased as part of a promotion.
- Tickets purchased on other sales platforms.
Please note that event tickets are the only items that can be offered and sold through the Ticketmaster Secondary Market platform, unless they have been purchased as part of a package containing additional items other than a ticket, such as a Meet & Greet, official merchandise, or parking access. In this particular case, you may only offer for sale on the Secondary Market the Tickets and additional items that are delivered or take place at the event venue; otherwise, only the Ticket may be included for sale through the Secondary Market.
All Secondary Market Ticket sales are subject to the following conditions and restrictions:
- You may not advertise Secondary Market Tickets for sale at a price higher than the price you paid for the Tickets.
- You may only offer Secondary Market Tickets that you own.
- When selling two or more tickets for numbered seats, you must ensure that they are located together.
- You may not offer Secondary Market Tickets that have been obtained in violation of our Purchase Policy or this Secondary Market Policy, or through the unauthorized use of any automated device or software, or through the creation of unauthorized frames or links to any website, or through any other illegal or unauthorized activity.
- You must not offer the same Secondary Market Tickets on any other similar platform at the same time.
- You will need a Hyperwallet account to receive payment for any Secondary Market Tickets you sell.
- We reserve the right to remove from the listings any Secondary Market Tickets that do not comply with any of the conditions set forth herein.
Ticketmaster may review offered or sold Secondary Market Tickets, so if we contact you, you must respond as soon as possible and within the time limits notified to you. If we are unable to contact you within the required time limits, the offer and/or purchase may be canceled.
4. CANCELLATION, POSTPONEMENT, AND MODIFICATION OF EVENTS
In the event of cancellation, postponement, or modification of an event, the following conditions shall apply:
4.1. If an event is canceled:
In the event of cancellation of the event for which you purchased Secondary Market Tickets, your purchase will be canceled and you may request a refund in accordance with our Purchase Policy. In addition, all current Secondary Market Ticket offers that have not been sold will be removed from the Secondary Market, so sellers may request a refund in accordance with our Purchase Policy.
If you have purchased Secondary Market Tickets for an event that will take place over several days and one or more days are canceled, please contact Ticketmaster through our Help Center.
4.2. If an event is rescheduled:
In the case of postponed events, tickets and seats for the rescheduled events will be honored, in accordance with our Purchase Policy. In addition, the event page will be updated with the new information, and all active offers will remain available for sale. However, as a seller, you may remove your Secondary Market Tickets from the list of offers (provided they remain unsold at the time of removal) so that you can request a refund for the Tickets originally purchased in accordance with our Purchase Policy.
For Secondary Market Tickets purchased before the announcement of the change or rescheduling of the event, buyers may request cancellation of their order, and their purchase will be refunded. If a buyer does not choose to cancel their order, the transaction will proceed as normal, and the seller will not be able to cancel the original Secondary Market Ticket order. Therefore, the seller no longer has any rights to the Secondary Market Tickets and will not be able to obtain a refund for those Tickets.
4.3. If an event is substantially modified:
In case that the event for which you have purchased Secondary Market Tickets is “substantially altered,” meaning a change (other than rescheduling) that makes the event materially different from the original event, the Secondary Market Tickets may be valid for the modified event. If you wish to cancel your order, please contact Ticketmaster through our Help Center to find out if you are entitled to a refund of the Sale Price of your Secondary Market Tickets.
The following cases will not be considered “substantial alterations”: the use of understudies in theatrical performances; adverse weather conditions; changes in any supporting act; changes in individual band members, changes in the lineup or billing of any multi-artist event, curtailment of an event when the majority of the event is performed in its entirety, and delays in the commencement of an event, and/or any other fortuitous event or force majeure.
In any of the above cases, applicable refunds will be made using the same payment method you used for the initial purchase.
5. WARRANTIES AND LIMITATION OF LIABILITY
You hereby represent and warrant that the information you submit to us in connection with your account and use of the Ticketmaster Services is true, accurate, and complete, and that you will not use false information, including contact information.
You further represent and warrant that by using our website and the Secondary Market, you will comply with all applicable laws and regulations, along with the terms of this Policy and any other applicable terms and conditions.
Similarly, you release us and our affiliates and/or subsidiaries, together with their respective officers, directors, employees, and agents (the “Indemnified Parties”) from any loss, damage, expense (including reasonable legal fees), liability, claim, and/or demand suffered by any Indemnified Party arising out of or in connection with a breach of this Policy or any other terms and conditions. expense (including reasonable legal fees), liability, claim, and/or demand suffered by any Indemnified Party arising out of or in connection with a breach of this Policy or any other applicable terms and conditions, a breach of any applicable law or regulation, or a breach of any third-party rights.
To the extent permitted by law, Ticketmaster (including our affiliates, subsidiaries, parent companies, and their respective officers, directors, employees, agents, legal representatives, and subcontractors) and the event organizers shall not be liable for any loss, injury, or damage to any person or property, regardless of the cause.

Our liability and that of any event organizer in connection with an event (including, without limitation, any cancellation, rescheduling, or change to an event) and any Secondary Market Tickets that have been offered, sold, or purchased shall be limited to the price you paid for the Secondary Market Tickets, including Service Fees, excluding Order Processing Fees.
We shall not be liable for any failure to perform any of our obligations under this Policy to the extent that the failure is caused by the actions or failures of the venues, artists, promoters, or other event organizers, or by an act of God or force majeure (i.e., any cause beyond our reasonable control, including, without limitation, war, insurrection, riots, pandemics, acts of terrorism, fires, explosions, floods, theft of essential equipment, malicious damage, strikes, lockouts, weather conditions, third-party court orders, national defense requirements, laws or regulations of national or local governments). It is understood that this clause does not affect the terms of any clause that specifically establishes a right to reimbursement.
Nothing in this Policy affects or restricts your right to file a complaint with the competent authority, if applicable.
If a court of competent jurisdiction determines that any provision of this Policy is invalid or unenforceable or becomes illegal, invalid, or unenforceable under applicable law, that provision shall be deemed omitted from this Policy and shall not prevent the remaining provisions from remaining in full force and effect and functioning separately.
This Policy shall be governed by and construed in all respects in accordance with the laws applicable in Mexico, and you agree to submit to the jurisdiction of the Mexican courts in relation to any dispute arising out of or in connection with this Policy.
